SMS Privacy Policy


Faropoint Ventures LLC and its subsidiaries (“Faropoint”, “we”, “us” or “our”) is committed to protecting your privacy and we make every effort to respect your wishes and Personal Information (as defined below). In line with this commitment, we have established the following policy for the use of SMS and text messaging with our clients. This SMS Policy (the “Policy”) governs how we treat the Personal Information that we collect and receive from you. Please read this Policy carefully to understand how we collect, use, and manage your Personal Information within the context described below. Please also review our Privacy Policy for more general information about our privacy practices which are incorporated herein by reference.

Faropoint reserves the right, in its sole discretion, to modify or change this Policy at any time with or without prior notice to you. The date of the last update will be posted at the top of this Policy for your convenience. This Policy, and any changes, are effective as soon as posted. Your continued engagement as a client of Faropoint following the posting of any changes to the Policy constitutes your full acceptance of those changes; provided, however, you may opt-out at any time by following the directions provided below.

“Personal Information” is information that individually identifies you, such as your mobile phone number or user/screen name, as well as the any Personal Information that you choose to include in messages you send to Faropoint.

Types of Messages

Faropoint sends informational SMS messages related to lease communications, appointment confirmations, property updates, and other property management matters. These messages are not marketing or promotional in nature. Message frequency varies based on account activity and property-related communications. Message and data rates may apply.

Collection of phone numbers

Faropoint collects your phone number(s) only when you voluntarily provide it to us, for example, during client intake, or when you fill out a form on our website. You can also opt in to receive SMS messages either by verbal or email confirmation with Faropoint personnel. We also maintain records of when and how you provided consent to receive SMS messages, including the method of opt-in (e.g., web form, keyword, or verbal consent). Message & data rates may apply.

What Personal Information is collected about you

Faropoint will receive the following information either directly or via third party service provider: your mobile phone number when you send a text message to us, the text of messages that you send to us, any user or screen name that you select when establishing an account on our platform for rendering services, as well as any comments or feedback regarding any aspect of Faropoint’s business that you may send to us.

How Faropoint uses Personal Information about you

We may use your Personal Information to:

  • (a) manage our commercial relationship, including without limitation, communicate informational messages about property management issues, lease terms, appointment confirmations, collections and the like,
  • (b) enforce any contract with Faropoint to which you are a party,
  • (c) respond to subpoenas, court orders, or legal process, or to establish or exercise Faropoint’s legal rights, or the legal rights of others, or defend against legal claims,
  • (d) investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person or property, violations of any Faropoint agreement (including any terms of service and/or privacy policy), or as otherwise required by law,
  • (e) process and respond to inquiries,
  • (f) improve our offerings,
  • (g) if necessary, contact you with important announcements or messages,
  • (h) conduct research, and
  • (i) provide anonymous reporting for internal and external clients and partners.

Each message that you send to Faropoint is stored on servers which are owned and operated by third parties.

Disclosure of your information

Unless we have your consent, we will not share your Personal Information with any third party besides our service providers which are required to maintain such information confidentially. For example, unless you consent in advance, no Personal Information will be shared with third parties for marketing and promotional purposes. Your mobile opt-in data and consent information will not be shared with or sold to third parties or affiliates for their own marketing or promotional purposes. Notwithstanding the foregoing, we may also share your Personal Information with a company controlled by, or under common control with, Faropoint for any of the purposes expressly permitted by this Policy.

Security

Faropoint takes precautions to ensure the security of your Personal Information, including ensuring that any third party service provider protects the security of your Personal Information. However, we cannot guarantee that hackers or unauthorized personnel will not gain access to your Personal Information despite our efforts. In addition, we cannot protect, nor does this Policy apply to, any information that you transmit to other users.

Opting in

By opting in, you provide your explicit consent to receive informational SMS messages from Faropoint regarding lease communications, appointment confirmations, property updates, and other property management matters.

A mobile user might opt in by:

  • Texting the keyword JOIN to a Faropoint business phone number and replying YES to confirm consent
  • Entering a phone number online
  • Sending a Mobile Originating (MO) message containing a keyword
  • Filling out a paper form (e.g., registration package, commercial agreement, etc.) that includes a mobile phone number
  • Providing verbal or email confirmation to Faropoint personnel during in-person meetings

Faropoint phone numbers are shared with tenants, prospective tenants, and business partners during in-person meetings. At the time the number is shared, the recipient is informed that by texting JOIN, they consent to receive informational SMS messages from Faropoint.

Carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Opting out

If at any time you wish to stop receiving SMS messages from us, you can opt out by texting any of the following keywords:

  • STOP
  • UNSUBSCRIBE
  • CANCEL
  • QUIT

After you send any of the foregoing SMS messages to us, we will send you an SMS message to confirm that you have been unsubscribed. After unsubscribing, you will no longer receive SMS messages from us.

If you want to join again, text JOIN to sign up as you did the first time or contact us directly for further service.

We reserve the right to send you certain communications relating to our commercial relationship, such as announcements and administrative messages, without offering you the opportunity to opt-out of receiving them.

Children

The Service is not intended for persons under the age of 18, and Faropoint does not knowingly collect information from any individual under the age of 18. By using the Service, you are representing that you are at least 18 years of age.
